Introduction
These Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) of Divadelní služby Plzeň, s.r.o. (hereinafter referred to as the “Seller”) regulate the mutual rights and obligations of the contracting parties arising in connection with or based on a purchase contract (hereinafter referred to as the “Purchase Contract”) concluded between the Seller and a natural person (hereinafter referred to as the “Buyer”) via the Seller’s online store.
These Terms and Conditions do not apply to cases where the person intending to purchase goods from the Seller is a legal entity or a person acting in the course of their business or in the performance of their independent profession.
User Account
The Buyer may order goods through a user account or directly on the Seller’s website without registration. The Buyer is required to provide accurate information.
The Seller reserves the right to cancel the user account, particularly if the account has not been used for more than 48 months, or if the Buyer breaches their obligations under the Purchase Contract.
Conclusion of the Purchase Contract
All presentations of goods displayed on the online store are informative in nature, and the Seller is not obliged to conclude a Purchase Contract for these goods. The Purchase Contract is concluded upon the Seller’s confirmation of the order sent to the Buyer via email.
Prices and Payment Terms
The prices of goods are inclusive of VAT and all related fees. The Buyer may pay the purchase price in the following ways:
• Cash on delivery
• Cash payment upon pickup
• Bank transfer to the Seller’s account
• Payment via ComGate payment gateway
The purchase price is payable upon receipt of the goods or in advance, depending on the chosen payment method.
Right of Withdrawal
The Buyer has the right to withdraw from the contract within 14 days of receiving the goods, unless it is a case where withdrawal is not permitted under Section 1837 of the Czech Civil Code (e.g., for goods customized according to the Buyer’s wishes).
Rights from Defective Performance
The Seller is liable to the Buyer for defects in the goods at the time of delivery and provides a warranty for quality in accordance with applicable legal regulations.
Claims for defects can be made at the address of the Seller’s business or registered office. Rights from defective performance are governed by the Czech Civil Code.
Data Protection
Personal data protection is provided in accordance with the General Data Protection Regulation (GDPR) and Act No. 110/2019 Sb. on the processing of personal data.
The Buyer agrees to the processing of their personal data by the Seller for the purposes of fulfilling the Purchase Contract and managing the user account. Personal data will not be provided to third parties, except for shipping companies.

Sending of Commercial Communications and Storage of Cookies
The Buyer agrees to the use of their data for sending commercial communications. The Buyer may withdraw their consent at any time. More information about cookies can be found in our Cookie Policy.
Alternative Dispute Resolution
The Buyer has the right to resolve disputes with the Seller out of court through the Czech Trade Inspection Authority (www.coi.cz) or by using the ODR platform (Online Dispute Resolution) available at ec.europa.eu/consumers/odr.
